Athens tree removal permits: what to check first

A small single-family lot, a multifamily parcel and a Milledge Avenue front yard can face different rules. Start with the parcel, not a blanket yes-or-no answer.

Four checks before
the first cut.

The official rule depends on the location, property and work. These steps narrow the question so you can get a useful answer from the right office.

Find the parcel and zoning

Check whether the site is single-family residential, multifamily, commercial or subject to an approved site or Tree Management Plan. If it is a street tree or the location is unclear, ask Planning before any cutting.

Check lot size and tree count

Athens-Clarke’s June 2026 guidance says no tree-removal permit is required on a single-family residential zoned lot under one acre. For a single-family lot over an acre, removing five or more trees requires a Timber Harvest Notice Application or a Zoning Permit Application to record removal. An approved plan, overlay or right-of-way can still change the route.

Check special conditions

A multifamily lot under 12,500 square feet may not need a tree-removal permit, but the county still calls for a Tree Management Plan to record existing and proposed tree removal. Larger multifamily lots require a TMP for canopy calculations. Commercial, industrial or institutional property should go to the county arborist.

Know the Milledge Avenue exception

The county’s applications page says certain front-yard trees in the Milledge Avenue Corridor Special District Overlay are protected, requiring a Zoning Permit and Certificate of Appropriateness before removal. Ask the county arborist whether the exact parcel and tree are covered.

A common question

What if the tree is dead or leaning?

A hazardous tree still needs a safe work plan. The official review flowchart routes approved plans, overlays, environmental areas and right-of-way trees to county staff. Do not assume condition alone waives a parcel-specific rule.
